State Rep. Ken Borton has put forth a plan aimed at safeguarding Michigan property owners from the challenges posed by squatters illegally occupying private property. The proposal, known as House Bill 5634, seeks to provide property owners with a more efficient process to remove squatters from their premises.
Borton emphasized the importance of addressing this issue promptly, stating, “Michigan residents should not have to undergo lengthy legal battles to regain control of property they legally own and pay taxes on.” He underscored the principle that trespassing is a crime, regardless of the duration, and should be treated as such.
Under the proposed legislation, property owners would be able to file a complaint with their county sheriff to request the removal of unlawful occupants. To initiate this process, property owners must confirm that they have instructed the squatters to vacate the property, verify that the occupants are not current or former tenants, and assert that any documentation provided by the squatters is fraudulent. Upon verification of the complaint, the sheriff would be required to promptly order the occupants to leave, with the option to arrest them for trespassing if they refuse to comply.
Borton's motivation for this initiative stems from the increasing reports of squatters in various parts of the country, including Michigan. He expressed his proactive stance, stating, “I refuse to sit by and wait until squatting becomes a larger issue here. We must give people the means to protect themselves and their property from illegal trespassers.”
The necessity of police intervention in such situations was highlighted by Borton, who emphasized that residents should not have to confront these challenges alone. He emphasized the potential risks posed by individuals who resort to illegal occupation, stating that families returning from vacations should not be exposed to such unpredictable criminal elements.
